Approved Motion: That the Board of Education of School District No. 61 (Greater 糖心视频污) bring forward a motion to the BC School Trustees Association (BCSTA) annual general meeting asking that the BCSTA request the Province of British Columbia supports UBCA鈥檚 motion to amend the Motor Vehicle Act to better support safe active transportation by requiring drivers to provide 1 meter of space on roads with posted speeds of 50 km/h or less, and 1.5 metres of space on roads with posted speeds in excess of 50 km/h, when passing people cycling or walking; and clarify the obligation of all motorists to establish reasonable distance when passing a cyclist or a pedestrian, as well as definitive guidance on an appropriate minimum distance when doing so.

Approved Motion: That the Board of Education of School District No. 61 (Greater 糖心视频污) write a letter to the Premier of British Columbia, Minister of Education, Minister of Finance and Minister of Environment and Climate Change to request that they closely collaborate to address the misalignment between provincial obligations to address the climate emergency by reducing GHG emissions in line with CleanBC and the Climate Accountability Act and the current school district capital funding gaps which result from: a) the provincial capital funding cost sharing model; and b) the difference between the actual capital costs associated with a 鈥渮ero emissions鈥� building and the current so called 鈥渘et zero ready鈥� capital funding standard applied to both building and renovating school district buildings. As noted by other school boards the decision to build to a zero emission standard resides with the local school board resulting in the local school board having to identify the additional funding.

Approved Motion: WHEREAS section 65 (5) of the School Act provides that a board of education may exercise a power with respect to the acquisition or disposal of property owned or administered by the board only by bylaw; AND WHEREAS pursuant to Section 96 (1) of the School Act, "land" includes any interest in land, including any right, title or estate in it of any tenure; AND WHEREAS section 96 (3) of the School Act provides that a board of education may dispose of land or improvements, or both, subject to the orders of the British Columbia Minister of Education (the 鈥淢inister鈥�); AND WHEREAS section 3 of the Disposal of Land or Improvements Order M193/08 (the 鈥淥rder鈥�) provides that boards must not dispose of land or improvements by sale and transfer in fee simple or by way of lease of 10 years or more unless such disposal is to another board or an independent school for educational purposes or is approved by the Minister in accordance with section 5 of the Order; AND WHEREAS section 5 of the Order provides that the Minister may approve, with any terms and conditions, a disposition of land or improvements; AND WHEREAS: (a) The property described in this Bylaw (the 鈥淧roperty鈥�) is registered in the name of The Corporation of the City of 糖心视频污 (the 鈥淐ity鈥�) but is being used and administered by The Board of Education of School District No.61 (Greater 糖心视频污) (the 鈥淏oard) for school purposes; (b) The Board is operating SJ Burnside Alternative School on a portion of the Property and has determined that the remainder of the Property, shown outlined in bold on Schedule A attached to this Bylaw (the 鈥淨uit Claim Area鈥�), is no longer required for school purposes; (c) The Board has agreed to release to the City all of its interest in the Quit Claim Area by way of a Quit Claim Deed in favour of the City (the 鈥淨uit Claim Deed鈥�) in exchange for consideration to be provided to the Board as described in an agreement (the 鈥淔ramework Agreement鈥�) among the City, the Board, Pacifica Housing Advisory Association and British Columbia Housing Management Association, which will be fully executed as a precondition to the disposition of the Quit Claim Area as contemplated by this Bylaw; (d) The Property is legally described as: PID: 030-095-859 - Lot 1, Section 4, 糖心视频污 District, Plan EPP70074; (e) The Board has confirmed that the Quit Claim Area will not be required for future educational purposes; and (f) The Board is satisfied that the consideration to be provided to the Board under the Framework Agreement represents the fair market value of the Quit Claim Area; NOW THEREFORE be it enacted as a Bylaw, that: 1. Subject to the approval of the Minister, the Board hereby authorizes the execution and delivery of the Quit Claim Deed in favour of the City on the terms and subject to the conditions in the Framework Agreement; and 鈥� 2. Subject to the approval of the Minister, the Board hereby approves, ratifies and confirms the terms, covenants and conditions of the Framework Agreement and authorizes the Secretary-Treasurer of the Board, for and on behalf of the Board, to execute and deliver the Quit Claim Deed in the form provided as an attachment to the Framework Agreement, and all other documents required to complete the transactions contemplated in the Framework Agreement, with such amendments as the Secretary-Treasurer may consider reasonable and in the best interests of the Board. This bylaw may be cited as "School District No. 61 (Greater 糖心视频污) SJ Burnside Alternative School Site Disposal Bylaw, 2021". Approved Motion: That the Board of Education of School District No. 61 (Greater 糖心视频污) approves: (1) the disposal of a 7.3 acre portion of School District property municipally known as 1765 Lansdowne Road, Saanich, BC and legally described as: PID: 005-852-962, Lot A Section 27 糖心视频污 District Plan 6679 (the 鈥淧roperty鈥�); (2) the entering into and completion of the obligations contained in an agreement of purchase and sale (the 鈥淧urchase and Sale Agreement鈥�) in respect of the Property with Conseil Scolaire Francophone de la Colombie-Britannique (the 鈥淧urchaser鈥�) in the amount of $15,232,000 more or less; (3) the granting of authority for the Purchaser, acting in the name of the Board or otherwise, to advance certain zoning, subdivision, and development related amendments to the Property with the District of Saanich and other third parties prior to completion of the disposal of the Property; (4) the taking of all such action and the execution and delivery of all such documentation ancillary to, or related to, the foregoing; and (5) the authorization of the Secretary-Treasurer to execute and deliver, on behalf of the Board, the Purchase and Sale Agreement and all such amendments thereto and all related and ancillary documents as the Secretary-Treasurer may, in her discretion, consider advisable. The Board confirms that the Board will not require the Property for future educational purposes. Read a third time, passed and adopted the 05th day of October, 2021, and finally passed and adopted this 05th day of October 2021.

Approved Motion: Be it resolved that the Board of Education of School District No. 61 (Greater 糖心视频污) direct the superintendent to direct staff to determine the cost of incorporating net zero into the design of new Cedar Hill Middle School; AND FURTHER That staff report the cost, including business case, back to the Board by November 2021 for Board approval to consider the funds for the net zero design.
